Legal Framework for Surrogacy in Georgia

Eligibility must be assessed under Article 143 of the Health Care Law and the birth-registration rules. In addition to medical and other legal conditions, those rules require an intended couple consisting of a woman and a man who have been married for at least one year or can establish at least one year of factual cohabitation with acceptable evidence. A clinic's willingness to provide treatment does not itself establish legal eligibility.

There is generally no urgency at the beginning of the process, allowing intended parents sufficient time to prepare and legalize required documentation before embryo transfer takes place.

Birth Registration and Parental Rights

Birth registration depends on the complete medical, notarial and civil-status evidence required for the case. Where the statutory conditions are met, the intended couple can be recorded as the parents and the surrogate is not recognised as a parent. Missing documents or a dispute can delay the process. Georgian registration does not automatically resolve foreign citizenship, passport or recognition requirements.

Once the birth certificate is issued, parents may proceed with passport application and citizenship procedures through the embassy of their nationality. Proper legal preparation prior to birth significantly simplifies this stage.
